This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder, as applicable, and is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and terms of use for access or usage of https://www.madebyher.in/(the "Website"), including any related mobile site (the "Platform"). This electronic record is generated by a computer system and does not require any physical or digital signature.

The Platform is owned and operated by Gita Devi, a sole proprietorship trading as MadeByHer, with its registered office at Narayana Child Hospital, MG Road, Aurangabad, Bihar (referred to below as "Platform Owner", "we", "us", or "our").

Your use of the Platform and its services is governed by the following terms and conditions ("Terms of Use"), including the policies referenced below, which are incorporated by reference. By using the Platform, you are contracting with the Platform Owner and these Terms of Use constitute your binding obligations. Any additional or conflicting terms you propose are expressly rejected and have no effect. These Terms of Use may be modified at any time without prior notice — please review them periodically.

Accessing, browsing, or otherwise using the Platform indicates your agreement to all the terms and conditions below. Please read them carefully before proceeding.

Using the Platform

  • You agree to provide true, accurate, and complete information when placing an order, and are responsible for all activity under your registered account.
  • We make reasonable efforts to describe products accurately, but neither we nor the sellers listed on the Platform warrant that all information (descriptions, photos, availability) is free of error at all times — handmade and homemade goods in particular may vary piece to piece.
  • Your use of the Platform and its services is at your own discretion and risk; you're responsible for assessing whether a product meets your needs before ordering.
  • The Platform's content — design, layout, look, and graphics — is proprietary to us or licensed to us. You have no rights to it beyond using the Platform as a shopper.
  • Unauthorized use of the Platform may lead to action under these Terms and applicable law.
  • You agree to pay the charges associated with any order you place, including product price, delivery fee, and any handling fee shown at checkout.
  • You agree not to use the Platform for any unlawful purpose or in a way forbidden by these Terms or by Indian law.
  • The Platform may link to third-party websites (e.g. a seller's Instagram, our courier partner's tracking page). We aren't responsible for the content or policies of those third-party sites.
  • Placing an order and completing payment forms a legally binding contract between you and the Platform Owner for that order.

Marketplace model

MadeByHer is a marketplace: it connects buyers with independent women-led sellers who list and fulfil their own products. Each product is made, packed, and shipped by the seller named on its page, not by MadeByHer directly. MadeByHer facilitates discovery, ordering, payment, and customer support, and steps in on disputes (see our Returns & Refund Policy), but the underlying sale is between you and the seller.

Indemnity & liability

You agree to indemnify and hold harmless the Platform Owner, its affiliates, and their respective officers and agents from any claim, demand, or penalty arising out of your breach of these Terms, our Privacy Policy, or your violation of any law or third-party right. Neither party is liable for a failure to perform caused by a force majeure event beyond their reasonable control.

Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts in Aurangabad, Bihar.
